Stockbridge Once Again Involved In Federal Lawsuit

The following was published by the Henry Herald.

Stockbridge business owner files federal complaint against council member, city
By Asia Ashley
Jun 19, 2017 Updated 2 hrs ago
STOCKBRIDGE— Stockbridge Councilman Elton Alexander and the city of Stockbridge could wind up in federal court over alleged First Amendment rights violations, retaliation and defamation.

The lawsuit, filed May 31 by attorney LaTonya Wiley in United States Northern District Court of Georgia, stems from a 2016 incident in which BBQ Masters owner Arick Whitson said Alexander allegedly asked Whitson for free food from his restaurant.

Whitson filed an ethics complaint with the city on Jan. 31, alleging that Alexander attempted to use his position as a council member to get $60 worth of free food from BBQ Masters. The lawsuit indicates the incident occurred in May of 2016 at the the North Henry Boulevard restaurant.

When Whitson refused, the suit claims that Alexander stormed from the restaurant and days later sent code enforcement to Whitson’s business to issue warnings for code enforcement issues. He says city’s code enforcement officer repeatedly harassed him by performing “warrant-less inspections at BBQ Masters,” issuing criminal warning notices, and “summoning Mr. Whitson to meetings to discuss manufactured ‘problems’ at BBQ Masters.”

After moving to a new location on Ga. Highway 138 in late 2016, Whitson claimed the harassment continued, stating in the lawsuit that the city delayed issuing him building and sign permits as retaliation. The city also denied his alcohol permit application without explanation months after filing his ethics complaint, the lawsuit claims.

“The aforementioned retaliatory, harassing denials delayed the opening of BBQ Masters thereby causing financial harm to Whitson and BBQ Masters,” states the complaint.

Since filing the complaint with the city, and speaking about the alleged infractions in the media, Whitson claims the attacks continued, but in a more public manner.

In the lawsuit, Whitson alleges that Alexander called BBQ Masters “a dump,” and “unsanitary,”over social media and in emails and accused Whitson of being a domestic violence offender who has engaged in “revenge porn.”

The lawsuit states Alexander has publicly called Whitson a convicted sex offender with “compulsive psychopathic behavior” and stated that Whitson was involved in a bad check incident.

The lawsuit denies that any of the accusations are true.
The lawsuit accuses Alexander of retaliating because of Whitson’s exercise of constitutionally protected speech, and “damaging Whitson’s reputations through an unfounded campaign of public disparagement accompanied by the deprivation of plaintiff’s property rights as secured by the 14th amendment.”

It further alleges, in part, that Alexander’s actions were sanctioned, condoned and authorized by the city and that the city “failed to properly train its officials and agents from violating the law in the manner decided herein.”

“As a direct and proximate result of defendants’ actions, BBQ Masters has been deprived of rights to which it was entitled and suffered business damage and loss of income and revenue as a result thereof,” the lawsuit states.

City Attorney Michael Williams declined to comment on the lawsuit, but said the city received the court summon late last week and plans to respond within the required 21 days. Alexander also declined to comment.

The lawsuit is seeking a judgment directing the city to issue requested permits, appropriate compensatory damages in an amount to be determined at trial, equitable relief against the city as allowed by the Civil Rights Act of 1871, and punitive damages against Alexander in his individual capacity.

We Are Headed For Dangerous Times In Henry County Georgia

I was at the Henry County Board of Commissioners meeting on June 6, 2017, when everyone was up in arms about the flag being removed at Nash Farm and the subsequent closing of the Civil War Museum at the park.  There was a woman from the NAACP who was
there saying she would rather see the Black Nationalist flag being flown there.  She would rather see it over the United States flag.  This is nothing but communism.  That group has had those leanings since it's inception.  This Black Nationalist flag is followed by the Nation of Islam led by Louis Farrakhan a devoted hater of the United States and what it stands for.  These people are pushing for the takeover of Henry County by Muslim Clerics and Sharia Law.  This is not American, but many of these pushing this idea are un-American anyway.  I find it very distasteful and offensive to see this flag in our nation.  Remember the man who was picked by the 2nd district commissioner to be on the parks and recreation board is an advocate of Ramadan which is the month-long Muslim holiday.  Do you want Henry County to become a Muslim haven like has happened in Europe?  Look how wonderful that is working out with terror attacks and murders daily.   You get what you vote for in these backward counties that have been turned upside down by a shift in ways of thinking and by those who want to be something and are nothing more than street thugs.  There should be a sign at the Clayton County line that reads Welcome to Henry County the Land that Allah is building.

NAACP Offends American Veteran At Nash Farm

I was at the Nash Farm rally against the Confederate Flag on June 3rd presented by the Henry County NAACP.  Being a member of the Clayton County Branch, I went in support of keeping the Confederate Flag down and out of sight.  But something happened while I was there that seriously damaged my viewpoint.  I served the United States in the Navy during Desert Storm.  I am proud of and will always defend the flag of the United States.  But I heard one of the key members of the Henry County Branch stand up there at the podium and say that she would rather see the "national flag" flying over the park.  The flag she referenced is the African American freedom flag that is used by the Nation of Islam.  This bothered me much.  I will be damned if I will follow under the national flag that honors terrorists.  I have rescinded my membership in the NAACP of Clayton County and do not want to be affiliated with any branch of that organization since the true idea is coming out.  True Americans should stand against what is really happening here in this matter.  People are being brainwashed daily about the Confederacy and their flag.  This is nothing more than "hate."  And they are supposed to be against hate.  What do they think the followers of Islam did to this nation on 9/11 and have continued to do since then around the world including the recent terror attacks in London.  Don't stand there blindly following what these people are doing.  It is a shame and disgrace to now realize that the NAACP was once a good thing but now has morphed into a cult of racial divisiveness that is fed on hate.  And wanting the flag that is followed by the nation of Islam is surely nothing less than hate.

Nash Farm Park Creating

At the June 6th meeting of the Henry County Board of Commissioners it was mentioned about the military museum that was to go in at Nash Farm Park.  It was a normal military museum dedicated to the more modern wars.  Also, mention was made about the Nash Farm master plan.  Below is some information about both.

Mr. Coley recognized Mr. Bob Van Dunk .  Mr. Van Dunk orchestrated where the Marine Corp Guard, the VFW and other veteran’s groups have consolidated to be known as the Henry County Veterans Association.  They have donated funds, time and efforts to make the museum possible.

Commissioner Jeffares made the motion to approve the resolution; Commissioner Stamey seconded.  The motion carried 5-0-0 approving the following resolution:

WHEREAS, the Henry County Board of Commissioners has previously authorized the development of a master plan for Nash Farm Park which includes passive park activities for the benefit of the citizens of Henry County; and

WHEREAS, in addition to such passive park activities, a portion of Nash Farm Park is to be dedicated to the preservation of certain historical and military actions; and

Authorization to submit a Recreational Trails Grant Application to the Georgia Department of Natural Resources

Mike Bush, Finance Director presented the agenda item to the Board.  Henry County has the opportunity to apply for a Recreational Trails Program Grant through the Georgia Department of Natural Resources.  The grant amount is $100,000 and the matching funds would be $30,000 of which $25,410 is in-kind and $4,590 is cash match.  The grant is for the development of recreational trails and maintenance of existing substandard trails at Nash Farm Park.  Recreational trails at Nash Farm Park are delineated in the Master Plan prepared for this site.

Commissioner Jeffares asked which department would provide the in-kind match.  Mr. Bush stated it would be several different departments.

Commissioner Bowman stated within the package it states volunteer labor, would all the labor from the different departments be volunteer.  Mr. Bush stated no, the volunteer portion would be for example the Friends of Nash Farm, people who would go on their own time under the county’s supervision.

Commissioner Bowman asked how the Personnel Department would volunteer $1,250.  Mr. Bush stated he believed that was for creating the grant itself.  Commissioner Bowman asked how staff came up with the $2,500 for public works.  Mr. Bush stated he did not have that information.

Commissioner Bowman asked if this grant was for one year.  Mr. Bush stated the grant is for construction of the trails and the county would maintain the trails.  Commissioner Bowman asked what the projected maintenance cost on the trails is.  Mr. Bush stated he did not have that information.

Commissioner Holder stated he continues to receive calls regarding the sign at Nash Farm.  There was a resolution to change the name of the park to Nash Farm Park.  Commissioner Holder asked when will the sign currently at the park that says Nash Farm Battlefield be changed.  Chairman Mathis stated that in the resolution it states that activities related to the Battlefield would continue to be referred to as Nash Farm Battlefield and those activities related to recreation would be Nash Farm Park.  Commissioner Holder stated the sign still reads Nash Farm Battlefield.  Chairman Mathis stated the sign cost $4,000 and is located next to the historical marker.  The idea was to place the new sign at the Babbs Mill Road entrance to the park.  Commissioner Basler asked if there was a way to move the sign to the battlefield area. If the sign needs to remain near the marker then it needs to be addressed and maybe the resolution needs to be readdressed.

Commissioner Jeffares stated this is an application for the grant and it will not be awarded until next year.  Commissioner Jeffares asked if awarded the grant are we obligated to accept the grant.  Mr. Bush stated that was correct the grant will not be awarded until the summer or fall of next year and the grant is for a maximum of $100,000 it could be less if deemed necessary.

Commissioner Jeffares made the motion to approve; Commissioner Holder seconded.  The motion carried 4-1-0 with Commissioners Jeffares, Basler, Stamey and Holder in favor and Commissioner Bowman opposed.  The following resolution was approved:

WHEREAS, the Board of Commissioners is the custodian of the county treasury and of county facilities in Henry County; and

WHEREAS, the Board of Commissioners has sponsored preparation of a Master Plan for Nash Farm Park; and

WHEREAS, this Master Plan incorporates recreational trails to link historical, cultural, and natural resources together along with greenspace; and

WHEREAS, the need for recreational trails is also referenced in the adopted Henry County Joint Comprehensive Plan; and

WHEREAS, the Board of Commissioners is aware of an opportunity to apply for Recreational Trail Grant Funds in the amount of $100,000 to facilitate realization of recreational trails consistent with the aforementioned Master Plan and Joint Comprehensive Plan; and

WHEREAS, the Board of Commissioners desires to formally authorize the filing of said application in accordance with the rules and regulations of the Recreational Trails Grant Program.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HENRY COUNTY that the Board hereby authorizes the filing of an application for grant assistance with the Georgia Department of Natural Resources relative to the Recreational Trails Grant Program.  The amount of the grant application is $100,000 and the total project cost (including local match) is $130,000.  Local match for this grant shall include cash match of $4,590 and in-kind match of $25,410; cash match funds are available in the Grant Match Account.

BE IT FURTHER RESOLVED that the Chairman is hereby formally authorized to execute and transit the aforementioned application to the Georgia Department of Natural Resources immediately upon adoption of this Resolution.

Poor Misguided Councilman Knows Not What He Does, Or Just Stupid.

The Stockbridge City Councilman Mr. A. S. was at the Nash Farm in Hampton on June 3rd with the NAACP protesting the CSA flag and the people who provided the museum for the farm to represent the Battle of Lovejoy.  This person who knows so little about history and only follows along to create trouble stood there with another man and defiled a historical monument to the Civil War dead of the Battle of Lovejoy.  Listed on that marker are the names of some of the Union and Confederate soldiers who died in the area.  This was a wanton disgrace and defaming of all that is decent.  He is the kind who would destroy headstones in a cemetery for his own push for an agenda.  One of his friends spoke there about the flag that should be flying over the park the U.S. flag, but she would prefer the nationalist flag which is one flown by the nation of Islam.  They both stood there holding the only flag that ever flew over a slave ship other than the British and Spanish flags.  Yes, they know about as much about history as to fill a thimble.  They are showing ignorance at a rate that hasn't happened in many years.  There was such a huge crowd there less than twenty showed up.  There was a much larger police presence than there were people there to put down the hallowed people who died for what they believed.  This was a typical socialist event.  There is no telling how many crimes were being committed in the county where those police were needed.  And it boils down to one thing.  They don't want white anything.  They want to support a muslim philosophy that will bring in more and more till one day it will be Ramadan Park.  And you can thank people like those commissioners and city council members who have taken over to run amok in the political world and have no idea what they are doing.  There was an old saying years ago that Atlanta shared and now Henry County is on the threshhold of sharing, "you wanted it, now you have it, what are you going to do with it."

Commissioner Wants A Planted Room For Her Hate Beliefs!!!

The next Henry County BoC meeting on June 6th at 9:00AM is going to be lively.  According to Ms. Clemmons who went on a black talk radio to get people to show up at the meeting to support her and her actions whether you live in the county or not.  She is trying to stack the room with her racist viewpoint followers.  She started all this when she sent workers out to Nash Farm a while back and had them take down the 2nd National Flag of the Confederacy.  Then, she went to an event at the Civil War Museum and told them to remove the flags from inside and to stop selling them.  This made the owner of the relics on loan there remove them thus closing the museum.  Her friend who sells meats to those who support Ramadan which is the holy month of the Muslims has been vocal in all this.  He has his farmers market there and lives about 1/2 mile from the farm.  This is something that has been on the radar of the commission since March when she notified the commission of her intentions.  She calls herself the smokinghotboss which in itself is disgusting.   She wants nothing, but black history to be told anywhere.  And so does her friends on the BoC and in McDonough Council and Stockbridge.  This type of problem started by her and then she wants to play the victim.  This is the ploy advanced for any communist group of which most progressive Democrats belong.  Remember if they get away with this then the people of Henry County are doomed to be trampled upon by these puppeteers of the race baiting alliance from Atlanta and beyond.
