A New Attack on Personal Freedom by a Local Municipality in Georgia

To begin with I would like to stress that I am not a smoker and never have  been.  I never 
wanted to smoke and it is my right  and choice not to.  And in the same vein, I feel that if 
someone wishes to smoke in their own car or home,  and yard that is their right to do so.
I have heard that the City of Stockbridge in Henry County wishes to create an ordinance that 
says you cannot smoke in your car with a child aboard.  I see this as a governmental intrusion upon the private life of a citizen.  In the Declaration of Independence, it says that people have the rights of life, liberty and the pursuit of happiness that show three examples of the unalienable rights which the Creator or God and which governments were created to protect. The City of Stockbridge should be protecting the individual right for a person to smoke in their car.  Georgia law says that the citizens car is an extension of their home.  I don't like seeing individual rights abated by the government in any form.  This is a road that has a slippery slope to it that will cause further governmental intrusion into your lives. The most obvious concern is perhaps the most troubling: a fear that these laws invite a new level of government intrusion into people’s private lives. Many people believe that they have a sphere of privacy in their cars, much like in their homes.  For example the following case law is a good point of reference:

In City of Zion v. Behrens,  the Supreme Court of Illinois invalidated a
city ordinance that made it unlawful to smoke tobacco in any public place because it was “apparently an attempt on the part of the municipality to regulate and control the habits and practices  of the citizen without any reasonable basis for so doing.”  The court further found that the ordinance could not be upheld on the grounds of preventing fire and protecting city property because it sought to control smoking in places other than those with highly combustible materials. This also would have carried over into the home and vehicle of the citizen and they found this unlawful. Another case law example is the following:

In Hershberg v. City of Barbourville,  for example, the Kentucky Court of
Appeals struck down a local ordinance that made it illegal to smoke within the city limits of Barbourville because the law was so broad as to make it illegal to smoke within one’s own home or other private premises and vehicles.  They found this unconstitutional. We must stress that we have to protect that which we don't like because if not then we are sacrificing our freedoms in the long run.

In summing up,  the right of privacy is a broad concept, used in diverse contexts to refer to a variety of claims or entitlements. One of the more significant branches of the right of privacy concerns the right of an individual to make personal decisions about his or her life free from government control; that is, the right of individual autonomy. The right of individual autonomy or privacy potentially may encompass matters such as the right to marry, the right to have a family, the right of reproductive freedom, the right of bodily integrity, the right to ingest substances such as alcohol and smoking,  the right to refuse medical treatment. and so on.  The concept of privacy or autonomy often is used interchangeably with the concept of liberty, both referring to a fundamental right of self-determination. The right of privacy is based on the principle that “a person belongs to himself and not others nor to society as a whole.” It embodies a sense of “personhood”—an “autonomy of self”—that should remain free from intrusion or coercion by society or the government. It comprehends that there are certain personal decisions concerning one’s life that an individual should be able to make for oneself free from interference by the state.  The right of privacy has developed primarily through decisions of the United States Supreme Court interpreting the Federal Constitution. It is the right of privacy for a person to smoke in a home or vehicle that is theirs.  If a child is in the vehicle the parent is usually the one who is driving and if they wish to smoke around their child it is their choice as  a parent.  When the government steps into your life in this manner to try and ban you from smoking in your car or home it is another step towards a dictatorial government that has it's fingers in too much of your life as it is today.  And for a city that has been embroiled in too many court cases for over a decade now, they shouldn't  go down this road of attacking a citizens rights.  They should go about the job they were elected to do and make sure the citizens have a police, fire, roads and utilities instead of getting into the cars and bedrooms of the community.

On December 12, 2016, The City of Stockbridge decided to go the idiot route once again. They were ready to pass a city ordinance that would make it illegal to smoke in your own car if there were a minor child in your car. As always when a tyrannical government wants to take more of your freedoms away they use the ploy “it’s for or to protect the children” tactic. Hitler did the same thing in the 1930’s and look what happened to the world then. Any time the government wants to take away your freedoms you should let your voice be heard. But Stockbridge does not like to hear from people that dislike what they believe in. Remember I was denied my first amendment right to speak at a Council meeting to ask for a Confederate history proclamation. Why you may ask? Because they were ignorant to the facts of the war. They are also very ignorant of the facts of smoking. They said in a blanket statement that smoking causes cancer. Which we often hear from neophytes who don’t want to accept the truth. That is a very stupid statement when there is no proof of it. I have loads of proof that smoking is not as bad for you and in some cases can protect you from some other health problems. The myth of second hand smoke was debunked years ago so the council by saying that second hand smoke is bad for you is a bald face lie!! This is very irresponsible of the City Council to lie to the people, but this is Stockbridge the red headed stepchild of Atlanta and Georgia.  They are wanting their five seconds of fame on the television news.  It is like a spoiled child wanting its way about everything.


The council did not vote on the ordinance because one councilman was not happy as to how it would be enforced and that it sounds like more big government. Now I hardly ever agree with Mr. Alexander like a lot of people in the County that call him the village idiot he never makes sense in what he wants to do. But this time he made sense in his statement. I urge you to contact the Stockbridge government and let them know that we smokers and nonsmokers see the smoke they are blowing up our butts by saying it’s for the children when  it is a big government way to generate money for them to spend on crap the city doesn’t need or want. It is a liberal hand working its way into the pockets of the hard working people of the city.  Stockbridge has had a bad image that the only thing that can clean it out is a City Hall Fleets Enema. Don’t let the city council continue to make a mockery of the hard working citizens of Stockbridge who feel they can walk over the rights of the citizens at their every whim.

The Democrat candidate for Henry County BoC Chairman is using Santa Claus to try and get a vote.  Carlotta Harrell is using a photo of her and Santa Claus and telling voters that your not nice if you don't vote for her on Tuesday November 6th.  This is a cheap way to use the Christmas spirit by hijacking the real meaning behind Santa Claus.  This is sad when politicians want to ruin the image of Christmas spirit with these tactics.  Sounds like a cheap trick from the Progressive Democrat Party of Henry County.

Another Day in the Life of Henry County
Do you really want this to become the Atlanta South that is constantly preached to citizens in the area.  These four hoodlums break into a home while a child calls his mom and stays safe.  This report from Channel 46 News is a story of a regular occurrence now in Henry County.  The citizens must demand help in fighting back against this in the area before it is lost totally to gang activity.  It can be done if people demand it from the board of commissioners who are over the police department.  Henry County can do better if they want to.

MCDONOUGH, GA (CBS46) -
An 11 year-old boy kept his cool and calmed his mother over the phone as four teens broke into the family's home.
The incident happened inside the family's home in McDonough.
The 11 year-old boy, whose mother doesn't want to be identified, says he heard a window breaking so he ran to a safe place to call his mother. The child's mother, who we'll only identify as Tenisha, says it seemed like a movie playing out in real life.
She says she felt terrorized when her son called her to tell her that something wasn't right.
"The only thing that I could see in my mind was the movie 'Taken'," said Tenisha. "I could just see somebody just coming in and taking him away. I was asking what was wrong and he said 'Mommy, I think someone is robbing the house'."
Tenisha says her son was alone at home when he heard a knock at the door. He saw four people circling the house and then heard the smashing of glass. That's when the boy ran to his room and called  his mother.
Tenisha says the first thing her son told her was, "Mommy, I need you to stay calm. That's the only way I'm going to stay calm. I need you to stay calm".
"It's a good thing that he was quickly responsive to what he heard because it could have been so different," said Tenisha. "I've always told him if you get into a situation, the only way that you're going to be able to think clearly is if you stay calm."
The police were called and Henry County officers arrived as the burglars were attempting to get away. They were apprehended and all four teens are facing burglary charges.

Terry Nichols Lucien, 19
Trelan DeJuan Spencer, 18
Fortunately, the boy wasn't hurt. The family says they don't think the burglars even knew he was in the house.

There are people out in America at this moment who do not understand why Hillary Clinton lost her bid to be President of the United States.  Ms. Clinton did well in the major cities and those metro areas attached to them, but it was the small towns and rural areas she underestimated.  Donald Trump brought something to the plate that Hillary Clinton failed to do.  He set a tone and message with the middle class and poor America that made them feel better and they could see something there that would make a difference in their lives.  All they saw in Hillary Clinton was the same old politician that would bring more of the same that they had grown sick of.  They also saw someone with power and money to try and buy what they wanted even if it meant destroying others. They see Donald Trump as something new for Washington.

Write In Don Henderson Henry County Chairman!!

October 17th is the kick off for early voting in Henry County.  Now is the time to do the right thing and Vote for Write in Candidate Don Henderson for Henry County Board of Commission Chairman.  We need a good honest man at the helm that is a true conservative.  Your only other options are two democrats and one of those is running as a republican.  Don Henderson is a viable candidate that will be good for Henry County.  So when you go to the polls remember to Write in Don Henderson for Chairman of the BOC.

Why I Am Not Voting For June Wood.
My experience serving with June Wood on the School Council at Eagles Landing High:

I found her to be polite and someone I liked as a person. But as an elected official I found June to be a “go along to get along person” following the principals lead for a do nothing School Council. Georgia Law provides a minimum specific list of activities and areas of interest for School Councils to explore. We did none of them, and when I asked her to support a move in that direction I did not get it. Which on first impression makes me come across as a sore loser; the truth, I, was not the loser because I tried, I fought, and I failed. The students, the teachers, the principal (yes the Principal), and the parents in the school community were the losers. Why? Because the community did not get the best we could have given as its servants. The difference between myself and some others; I take my responsibilities toward the public seriously. I would rather fail by doing my best to serve, than fail by going along to get along. I cannot say the same for June Wood in our shared experience.

I also freely admit the elected school Council position is lower on the ladder than Dog Catcher, and you don’t receive any compensation beyond knowing you did your best. Still, elected members are required to follow the guidance provided in Georgia law, do what is right for the school community, without agenda, and without an axe to grind.

If June Wood cannot or would not serve as required or lead in a school community as small as Eagles Landing, what can we expect her to do for Henry County?

Can she play politics?
I have observed her playing the game.
Does she have a history of standing up and taking the hit on the job for the community?
Not that I am aware of.
But if you know a different story, it would be interesting to read it.
I wish her well.
